This webpage’s Terms & Conditions (“terms”) sets out the basis on which manages your usage of CocoTutors’ website. The website is CocoTutors’ (of UEN53378205L) ownership (hence referred to as CocoTutors). By visiting our website www.cocotutors.com (our “Site”), you accept and consent to the terms set out below. You must not use our website if you disagree with any of our terms in this webpage. The terms are applied to all visitors, users and others who access or use this Website.

1         General

(i) CocoTutors provides referral services to parents, students and tutees (hence referred to as “customers”), by matching them with tutors registered with CocoTutors when they request for home tutors.

(ii) All visitors to the Site, whether they requested for our services or not, shall be deemed as “users” of the services we provide contained in this terms. Once users request for our services, they shall be considered as “customers”. There are two types of customers; “tutee” that requests for tutors based on their needs, “tutor” that is registered on CocoTutor’s website providing tuition services to tutees.

(iii) If you use our Site, you are deemed to have agreed to our Terms and Privacy Policy, which may be subject to changes from time to time. Should you not agree to our terms, you must stop using our services immediately.

(iv) CocoTutors is not responsible for any wrong actions, miscommunication, etc. as a result of providing our Services.

2         Registration

(i) When you register with CocoTutors, CocoTutors may collect information such as, but not limited to: your name, birth date, gender, occupation and academic qualifications. The purpose of collection of these information is to suit and match our tutee’s preferences. There is no violation of Article 12 of the Constitution of the Republic of Singapore.

(ii) Users who wish to register with CocoTutors as a tutor must be 18 years of age, and is a Singaporean, Permanent Resident, or holds a student pass.

(iii) Users who registers as a tutor CocoTutors are required to provide accurate, valid, and current information about themselves when filling out the forms on the Site. Should there be any changes to the information you provided, you must update it to keep it actual, true, and accurate. CocoTutors is not responsible for any failure in providing Services due to inaccurate, not up-to date information. If you are found to have provided false or incorrect information, CocoTutors reserves the right to terminate our Services provided to you, immediately without prior notice, and if deemed to be very serious, escalate to relevant authorities for further action.

(iv) CocoTutors has the right to use your information for its intended purpose, for example posting or publicising a tutor’s profile (no sensitive information) on social media platforms for attracting clients or sending it to tutees directly. Or, for instance, providing the contact number of a tutee to a tutor who has arrived at their doorstep. Information as your name, telephone number, date of birth, etc. will not be disclosed to the public. For full information, look at our privacy policy.

(v) CocoTutors reserves the right to request copies of your original certificate for verification purposes, so that your credentials are verified. You are recommended to bring your certificates on the first lesson to present and verify your credentials with tutees and tutee’s parents.

3         Commission and Payment

(a) Commission

       (i) CocoTutors will collect 50% of tutor fees for the first 4 weeks of active tuition. We will collect the amount for the agreed number of lessons to be completed, notwithstanding missed lessons due to sickness, etc. CocoTutors will collect the agent commission fees from the tutee/tutee’s parents directly, although in some instances CocoTutors will collect the fees from tutors instead (i.e parents would like to bypass the tuition agency, etc.). In this case, tutors have the responsibility to inform us via your respective tuition co-ordinators. Tutors shall not collect the agency commission from the tutees directly. Tutees who choose to bypass the agency and pay the commission fees tutors directly, shall be liable to pay the full commission amount and additionally, administrative fees incurred by the agency, if we fail to collect the commission amount from the tutor.

       (ii) If tutee decides to cancel, terminate, or change tutors before the end of 4 weeks of active tuition, the commission will be adjusted accordingly to 50% in tutor fees of completed lessons. However, the commission will still be collected from the tutee or tutee’s parents directly, which would then be transferred to the tutor within 3 business days.

       (iii) CocoTutors reserves the right to change commission if deemed necessary, such as nonfulfillment of tutor’s obligations. Tutees are liable to pay for all completed tuition lessons, regardless or how satisfactory the lesson was. For more information regarding our Commission Policy which supplements this set of terms.

(b) Payment

       (i) CocoTutors will collect the commission fees from tutees or tutee’s parents directly via payment methods as stated here. The agent fees are to be paid by the tutee or tutee’s parents by the due date stated on the official email invoice. Late payments will be subjected to $50.00 administrative fee (late fee), for payments made 1 week after the due date stated in the invoice.

       (ii) If there are any changes in tuition details, such as change in tuition frequency, hourly rates, that will lead to change in tutor fees hence commission, it is the duty and responsibility of both the tutee and tutor to inform the agency, CocoTutors, of the change. These changes must be mutually agreed between both tutees and tutors. We will then adjust our commission rates accordingly.

       (iii)Any attempt to skip payment of the commission; failure to pay for the commission or unreasonable demands will result in the termination of your access to CocoTutors and our Services and you will be barred from future registration.

       (iv) If there are disputes or concerns regarding tuition fees between tutors and tutees, CocoTutors will provide assistance, to our reasonable means, to help tutors to claim fees from clients and vice versa. However, CocoTutors shall not be legally responsible for any payment disputes between tutors and tutees. Refunds may be made to the client’s bank account in case of violations of terms because of the tutor’s fault, or other reasons.

4         Conduct of Tutor

Tutors are to conduct themselves appropriately in a professional and ethical manner. CocoTutors reserves the right to refuse Services to customers and users who does not abide to our Terms and whenever we deem appropriate at our discretion, without prior notice.

General rule of conduct includes, but are not limited to:
       (i) Be on time; do not be late, and do not end tuition early; stay for the whole duration.
       (ii) Give a day of notice if there is any changes in tuition, such as absence or cancellation due to sickness. A Medical Certificate must be provided.
       (iii) Purchase of assessment books or any supplementary materials that costs money to be mutually agreed before bought.
       (iv) No physical or verbal abuse is tolerated (all forms).
       (v) Regular communication and updating of tutee’s parents to take note of their Child’s progress.
       (vi) Informing CocoTutors immediately of any changes to tuition details, such as tuition frequency, hourly rates etc, via respective tuition co-ordinators that assigned you the job.

Tutees will rate their tutors at the end of the first month of tuition, or upon cancellation or change, on overall tuition quality and standard, based on different criteria. Tutors will then receive feedback from CocoTutors on how to improve, and better their quality of Education they are providing. Tutors will receive a tutor rating that will not be disclosed to the tutors, upon completion of the questionnaire. Tutors’ access to our Services may be limited if their tutor rating and performance is deemed to be unsatisfactory upon our discretion.  

5         Copyright

(i) All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on CocoTutor’s website belong to the CocoTutors and/or third parties (which may include you or other users.) CocoTutors reserves all of its rights. Reuse of any materials without prior permission is prohibited except as explicitly stated in the Terms.

6         Termination

(a) Tutees

        (i) By You (tutees). Tutees can only terminate the use of our provided Services at any point in time after the completion of the first lesson, after tuition details are confirmed. Tutees are still required to pay for all tuition lessons completed by the tutor, up till termination, to CocoTutors. There is a contractual obligation to complete at least 1 lesson after tuition details are confirmed with both tutor and tutee, thereafter completing the first lesson, there is no obligation for the tutee to complete a fixed amount of lessons before terminating. Should the lesson be terminated prior to completing 1 lesson after tuition details are confirmed, tutee will be liable to pay 50% of the first lesson to CocoTutors.

        (ii) By CocoTutors. CocoTutors may limit, suspend or stop providing the Services to tutees if tutees fail to comply with these Terms (such as failure to pay fees when due), or if tutees use the Services in a way that causes legal liability to us or disrupts others’ use of our Services. We reserve the right to terminate services immediately without notice if we deem necessary.

(b) Tutors

       (i) By CocoTutors. As a tutor, you agree that CocoTutors may, without any prior written notice, immediately suspend, terminate, discontinue and/or limit your account and access to any of our Services. The cause for such termination, suspension and/or limitation of access shall include, but is not limited to: breach of Terms and Conditions, by request of law enforcement agencies or government, nonpayment of outstanding fees, unethical conduct and poor performance.

       (ii) As a tutor, you may also terminate your status as a tutor associated with CocoTutors by submitting a termination request via email.

Furthermore, you agree that CocoTutors may cease operations at any time, without prior notice.

7         Links to Other Web Sites

(i) CocoTutors may provide links to other third party websites or resources. You acknowledge and agree that CocoTutors shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such sites or resources.

(ii) You are responsible for reading and agreeing (or disagreeing) with the Terms and Conditions or Privacy Policies of these third party websites, and CocoTutors are in no way, shape or form responsible for links to these Sites.

DISCLAIMER OF WARRANTIES; LIABILITY LIMITATION

YOU EXPRESSLY AGREE THAT:
(i) COCOTUTORS DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF OUR SERVICES OR WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT COCOTUTORS MAY REMOVE OR CANCEL OUR SERVICES AT ANY TIME, WITHOUT NOTICE TO YOU.
(ii) OUR WEBSITE AND SERVICES ARE PROVIDED ON A “AS IS” AND “AS AVAILABLE” BASIS, FOR YOUR USE. YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT.
(iii) COCOTUTORS IS NOT LIABLE FOR THE ACCURACY OF INFORMATION AT ANY POINT IN TIME, AS CONTENT MAY BE INACCURATE, OUT-OF DATE AND IS SUBJECT TO CHANGE WITHOUT NOTICE.
(iv) COCOTUTORS DOES NOT WARRANT THAT THIS WEBSITE, ITS SERVERS, OR E-MAIL SENT FROM COCOTUTORS.COM ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS THAT HAS DESTRUCTIVE OR CONTAMINATIVE PROPERTIES. YOU ARE RESPONSIBLE FOR CARRYING OUT SUFFICIENT PROCEDURES AND VIRUS CHECKS OR SCANS.
(v) COCOTUTORS HOLDS NO LEGAL LIABILITY FOR PROBLEMS AND DISPUTES ARISING BETWEEN TUTEES AND TUTORS, WE CANNOT GUARANTEE SATISFACTORY RESULTS.
(vi) COCOTUTORS OR ANY OF ITS EMPLOYEES, AGENTS SHALL BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM ANY USE OF OUR SERVICES OR WEBSITE, INCLUDING BUT NOT LIMITED TO, DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE DAMAGES.
